DOWNERS GROVE - Republican candidate for U.S. Senate Doug Truax called on incumbent Dick Durbin to stop using our tax dollars in his relentless campaign to abridge the First Amendment rights of American citizens who don't agree with him politically.
Truax was referring to the extraordinary taxpayer-paid letter Durbin wrote to Americans who exercised their First Amendment rights by supporting an advocacy group Durbin opposes. The letter was the basis of a story this week in the Washington D.C. based publication Roll Call.
The letter comes just a few weeks after it was pointed out in the context of the IRS scandal that Durbin tried to persuade the IRS to investigate another advocacy group he opposes in an Oct. 12, 2010 letter.
"This is America, not the Soviet Union," Truax said. "You would think Dick Durbin would comprehend that our constitutional right of free speech is not his to trample. His arrogance is breathtaking and should disturb all Americans who value the First Amendment.
According to Roll Call, Durbin wrote an accusatory letter to approximately 300 donors of the free market and limited government advocacy group American Legislative Exchange Council (ALEC). He was asking detailed questions about their position on "Stand Your Ground" legislation. Durbin chairs the Senate Judiciary Committee Subcommittee on the Constitution, Civil Rights and Human Rights and has announced he will stage a "Stand Your Ground" hearing this fall.
Durbin's letter requested a response by Sept. 1.
Truax said Durbin needs to explain how he got ALEC's donor list to mail the letter. The United States Supreme Court has ruled that Americans such as ALEC's donors have First Amendments rights to support any group they choose without disclosure.
And he urged the donors to ignore Durbin's letter because the donors are under no obligation to participate in his partisan witch hunts.
"You would think after the IRS scandal Dick Durbin would be more sensitive about trying to intimidate his political opponents," Truax said. "If Dick Durbin feels this is how America ought to operate, he needs to re-read the First Amendment and start acting like he understands it."
