Durbin not ruling out filibuster with Supreme Court vacancy

Well, that didn't take long...Dick Durbin says the chance of a filibuster is remote, but according to Crain's Chicago Business (free registration may be required), the possibility of a filibuster fight in getting O'Connor's successor confirmed by the senate is there.

The number two Democrat in the U.S. Senate Friday urged the president to nominate someone of “independence, balance and moderation” to succeed retiring Supreme Court Justice Sandra Day O’Connor.

But, in a midday press conference here, Sen. Dick Durbin of Illinois made it clear his party is prepared to fight if the president veers too far to the right.

The White House should continue and expand preliminary talks with Democrats that have occurred in recent weeks, and come up with a nominee who is “conservative” but not extreme, someone “down the middle,” said Mr. Durbin, a liberal.

If the White House does otherwise, Democrats could filibuster, he continued, though he described that option as “remote.”
